Terms & Conditions
Definitions
In the context of these terms and conditions:

'Seller' means Hamilton Brass whose registered office is at 43 Cranshaw Drive, Blackburn, England, BB1 8RE.

'Buyer' means any customer of the Seller (whether a person, firm, or company or any agent, or authorized representative of such person, firm, or company) purchasing goods from the Seller.

'Goods' means all and any goods, materials, or products of whatsoever description supplied, sold, or distributed by the Seller.

'Conditions' means these terms and conditions of sale and any of them.

'Contract' means any contract entered into between the Seller and the Buyer by which the Seller sells or supplies goods to the Buyer.
Payment – Cash & Carry Customers
The Buyer shall pay in full for all goods purchased from Hamilton Brass via cash, debit card, or credit card before leaving Hamilton Brass’s premises. Hamilton Brass will only accept payment by cheque or other negotiable instruments with prior written consent.
In the event of payment by cheque or similar method being dishonoured by the issuing bank, Hamilton Brass reserves the right to either:

Inform relevant authorities that an act of fraud may have occurred; or
-
Re-present the payment instrument, with the associated cost borne by the Buyer.
In such cases, interest on all overdue amounts will accrue daily at a rate of 4% per annum above HSBC’s base lending rate from the date of the Contract until the date of payment.
Delivery
Unless expressly agreed in writing, all delivery times provided are estimates only. Time shall not be of the essence. Hamilton Brass shall not be liable for any direct, indirect, or consequential loss resulting from delays in delivery.
Passing of Risk
Risk in the goods shall pass to the Buyer:

If collected: when goods are loaded onto the collecting vehicle or removed by the Buyer or their agent.

If delivered: when goods are unloaded at the address nominated by the Buyer or their agent.
Notification of Defects and Return of Goods
The Buyer must notify Hamilton Brass of any defect or damage within:
-
2 days of collection or delivery; or
-
Within a reasonable time after discovery if the defect was not initially apparent.
Notification must:
-
Clearly identify the defect or damage; and
-
Allow Hamilton Brass a reasonable opportunity to inspect the goods.
If Hamilton Brass agrees that goods are defective, it may at its discretion:
-
Rectify the defect;
-
Replace the goods; or
-
Credit the invoice value.
This action shall constitute full and final satisfaction of any claims.
Claims will be invalid if:
-
Goods are mixed with other items; or
-
The goods undergo further manufacturing by or for the Buyer.
Any such alterations shall be deemed a waiver of claim.
Return of Goods
Hamilton Brass may allow returns at its absolute discretion within one month of the original purchase date. If a return is accepted, Hamilton Brass is entitled to retain a 15% handling fee of the sale price.
Intellectual Property
The supply of goods does not grant the Buyer rights to use Hamilton Brass’s trademarks (registered or unregistered) or any other intellectual property without prior written consent. All IP rights remain the sole property of Hamilton Brass.
Third-Party Claims
If the Buyer resells or distributes the goods to any third party, Hamilton Brass is not liable for any resulting claims from those third parties.
Proceedings
If legal action is initiated or threatened against the Buyer relating to allegedly defective goods, the Buyer must notify Hamilton Brass in writing within 3 days. Failure to do so will release Hamilton Brass from all liability related to such proceedings.
Hamilton Brass may, at its discretion, request the return of the goods for a full or partial refund, provided the situation complies with the return policy stated on our website.
